Zephyr only collects Personal Information, such as your name, address, age, telephone number, and e-mail address, that you voluntarily provide to us. You are not required to provide Zephyr with any such information, but if you choose not to you may be unable to use or access certain Services or portions of the Site.
Zephyr may ask you to provide certain Personal Information when you purchase Services from Zephyr or when you register for events or contests. Zephyr also may ask you to provide Personal Information in other limited circumstances specified at the time the information is gathered.
In addition to voluntarily given Personal Information, Zephyr collects Site activity information (through the use of “cookies”), IP addresses, demographic information and information supplied by third parties.
Zephyr’s Web server automatically creates log files for each Site User to allow Zephyr to monitor Site use and to make our site more useful to our visitors. The access logs do not contain personal information, but contain information relating to the details of a User’s Site visit, including the IP address of the visitor, the date and time of use, the path taken through the Site, files reviewed and downloaded, and errors encountered.
Zephyr may collect non-Personal Information that is not capable of specifically identifying an individual such as zip codes, ages and income levels. Zephyr uses such information to improve the Site and Services and better target its Users’ needs and preferences.
Third Party Information
Zephyr also uses ‘cookies’. A cookie is a piece of data that can be written to a User’s hard drive when the User visits our Site. These cookies are activity recordation files that store information on a User’s Site visits and preferences. Zephyr does not, for example, scan a User’s hard drive for other information not located in the cookie.

Use of Information
Zephyr uses collected Personal Information to perform Services, customize and optimize the Site, and for other internal purposes, such as sending information to the User about the User’s account, Zephyr’s Services, and advertisements for products and services that may be of interest to User (these and any other communications using Personal Information are “Notices”).
Except as otherwise expressly stated herein, Zephyr will use and disclose your information for its own internal business purposes, which include responding to User e-mails, fulfillment of product and service orders, sending communications to Users, including marketing and promotional communications, and other general Zephyr operations.
Personal Information collected by Zephyr is not provided to unaffiliated third parties, except when the User specifically consents to such distribution or when Zephyr discloses information to third parties as provided under “Exceptions” below.
This policy covers only information that is collected specifically and solely by Zephyr. Any information that you disclose when participating in newsgroups or other public internet forums becomes public. Moreover, by participating in newsgroups, your e-mail address may become available to any third parties accessing our Web site and as a result, you may receive unsolicited e-mail from such third parties.
If you do not want your Personal Information to be collected or used for any of these purposes, you may “opt out” by following the process described below. Please note that opting out may limit or terminate your access to portions of the Site, the Services, or other functions provided by Zephyr.
Exceptions to Use of Information
NOTWITHSTANDING ANY RESTRICTIONS OTHERWISE STATED HEREIN, ZEPHYR MAY DISCLOSE USERS’ PERSONAL AND NON-PERSONAL INFORMATION IN THE FOLLOWING CIRCUMSTANCES:
- If Zephyr believes in its sole discretion that disclosing this information is necessary or reasonable to enforce the terms and conditions of our Site or Services or Zephyr’s rights in connection with the Site, Services, or User;
- If Zephyr reasonably believes that applicable law, or order requires the disclosure;
- As part of negotiations and due diligence for, and as part of, the sale of our business or any of its assets.
Zephyr has undertaken what it believes are reasonable security policies and procedures to secure the information we collect online. We do not collect or store credit card information within the Zephyr website. Credit card information requested by Zephyr is protected by 128-bit encryption and Secure Sockets Layer (SSL) security features.
Certain User functions are password-protected. User should not give his or her password to any third party or otherwise allow the password to become known (by not logging out after ending a session, for example). Despite its efforts to maintain security and confidentiality for information, Zephyr does not warrant or otherwise promise that there will be no unauthorized access to, use or disclosure of User information, including Personal Information.
The Site and Zephyr’s Services are not intended for use by children, and Zephyr does not knowingly collect any Personal Information from children under 13. If you are under age 13, you may not submit or post any information or material on the Site or otherwise provide such information to Zephyr, including but not limited to Personal Information.
Unless otherwise specified, you must be at least 18 years old in order to participate in any online contests or other Site events or functions.
Zephyr encourages parents to monitor the websites that their children visit. Zephyr relies in part on parents to prevent unauthorized access to the Site and the Services, and to comply with the provisions of this statement.
